The South Shall Rise Again!

Today is Saturday, 26 January 2013.

Two Oklahoma Republican legislators have filed bills in the state Legislature, which would "nullify" the Affordable Care Act, and send any U.S. government official who tried to enforce it to prison for up to five years.

"Nullification" is a spurious legal fiction concocted by Senator John C. Calhoun of South Carolina and others in 1832, during a tariff bill tiff.  The doctrine imagines that each of the several states , when it pleases its fancy, is in fact not part of the USA, but a sovereign foreign country, which can therefore hold any Federal law null and void.  The truth is that the independence of the several states ended forever in 1789, when the Constitution took effect, and said states were subsumed into the Union.  Further attempts to extend nullification (and the equal falsehood of "state's rights") were put paid by the Civil War.

One could easily argue that the filing of such bills constitutes an attempt to overthrow the USA, and that the prepetrators should be severely punished.

I can only imagine:  a) these legislators scored 5% on American history tests, b) they know they're pumping bullshit, but it's just willie-waving in anticipation of the next election, or c) they are "barking mad."

They should be nullified.

Same legislation, same nullification theory in Alaska by the Speaker of the House granting authority to arrest any Federal officials attempting to enforce Federal firearms law.
